1. Parties and acceptance of these terms
Kallivra is an AI-powered character chat service provided by Monay Studio. These Terms of Use ("Terms") form the agreement governing your access to the Kallivra website, iOS and Android applications, and their related features (collectively, the "Service").
By creating an account, accessing the Service, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. Eligibility and account security
Kallivra is intended exclusively for adults aged 18 or older. You may use the Service only if you are at least 18, have the legal capacity to enter into this agreement where you live, and are not prohibited from using the Service under applicable law.
Account-based features on Kallivra's web and mobile applications may require you to sign in with Google or Apple. You are responsible for keeping the information you provide accurate and current, protecting access to your account and device, and all activity under your account. Promptly report suspected unauthorized use to hello@monaystudio.com.
3. Scope of the Service
Kallivra is a romantic AI companion and interactive storytelling service. It may provide features for discovering and creating adult fictional characters, defining scenes, private character chat, romantic role-play, conversation memory, generating scene images under eligible plans, and turning generated scene images into videos. Kallivra is not a pornography service, adult-content marketplace, dating service, escort service, or platform for sexual interaction between users.
We may modify, limit, or discontinue all or part of the Service for maintenance, security, legal requirements, or product decisions. Where practical, we will provide reasonable notice of material changes. Your mandatory consumer rights remain unaffected.
4. AI-generated content and important notices
Character responses, memory summaries, images, and videos are created by automated systems. They are not statements by a real person and may be inaccurate, incomplete, outdated, disturbing, or unexpected. Even if a character resembles a real person, this does not mean that you are communicating with that person.
Romantic themes may arise in private fictional conversations, but pornographic or obscene content, explicit sexual imagery, and content intended primarily for sexual gratification are outside the permitted scope of the Service.
The Service is not a medical device, healthcare service, psychotherapy service, crisis hotline, or legal, financial, or other professional advisory service. Do not rely on Kallivra in an emergency; contact local emergency services or an appropriately qualified professional. Verify information through independent, reliable sources before making important decisions.
5. Free access, subscriptions, and payments
Some features may be available for free, while higher usage limits or additional features may require a paid subscription. Current pricing, currency, billing period, taxes, trial period, and included entitlements are shown on the purchase screen. Information on the purchase screen takes priority over general promotional language.
Unless expressly stated otherwise, subscriptions automatically renew at the end of the selected billing period, and the stored payment method is charged until you cancel. You can cancel through the account or subscription management section of the channel where you purchased the subscription. Cancellation generally does not affect access until the end of the current paid period and prevents the next renewal.
Web purchases are processed by the independent payment service identified during checkout and on the purchase receipt. Payments and refunds are subject to the rules of the channel through which the purchase was completed. Review our Refund Policy before purchasing. Unless required by law, partial refunds for completed periods and transfers of unused entitlements are not guaranteed. Mandatory consumer rights, including cancellation and refund rights, remain unaffected.
Plan limits may reset within the relevant daily or monthly period. Unless stated otherwise, unused entitlements do not carry over to the next period. If payment cannot be collected, paid features may be suspended or the account may be moved to a free plan.
One-time scene credit packs are not subscriptions and do not renew automatically. Each pack remains valid for the period shown on the purchase screen, starting on the purchase date. Credits not used within that period expire and do not carry over. Additional packs are added to the account with their own separate validity periods.
6. Content you provide
You are responsible for messages, character profiles, scenes, images, feedback, and other content you submit to the Service. You retain any rights you already hold in your content. To operate the Service, you grant Monay Studio a worldwide, non-exclusive, royalty-free license to host, reproduce, technically format, transmit to model and infrastructure providers, and use that content solely to provide the features you request.
Monay Studio does not use your content for advertising targeting or to train its own general-purpose AI model. However, whether third-party AI providers processing your request use data for service security, improvement, or model optimization depends on their own agreements and policies, as explained in the Privacy Policy. This license ends when your account and content are deleted, except as needed for safety, legal retention, dispute resolution, and limited backup requirements.
Submit only content for which you have the necessary rights. Do not use another person's private data, likeness, or intellectual property without permission. We strongly recommend that you do not include health information, biometric data, political opinions, religion, sex-life information, or similar sensitive data in chats.
7. Generated content and intellectual property
To the extent permitted by applicable law, Monay Studio will not assert ownership against any rights you may have in content generated from your input. AI outputs may not be unique, however, and the same or similar content may be generated for other users. We do not guarantee that an output qualifies for copyright protection, does not infringe third-party rights, or is suitable for commercial use.
The Kallivra name, design, logo, software, prebuilt characters, and original content provided by Monay Studio are protected by applicable intellectual property laws. You receive only a limited, non-transferable, revocable right to use the Service in accordance with these Terms for personal, non-commercial purposes.
8. Prohibited uses
You may not use the Service to:
- Violate applicable law or third-party rights,
- Generate, request, share, or facilitate content that abuses or exploits children,
- Generate, request, upload, or share pornographic or obscene content, explicit sexual imagery, nudity intended for sexual gratification, or sexually explicit depictions or descriptions,
- Promote threats, harassment, hatred, discrimination, abuse, human trafficking, terrorism, or conduct likely to cause serious real-world harm,
- Commit fraud, impersonation, defamation, privacy violations, or unauthorized collection of personal data,
- Transmit malware; bypass the Service, safety measures, or usage limits; reverse engineer or scrape the Service; or create excessive load through unauthorized automation,
- Create characters or content that infringes intellectual property, personality, likeness, publicity, or privacy rights,
- Misleadingly present AI-generated output as human-created or definitively accurate information.
9. Moderation, content removal, and account action
Kallivra uses automated safety controls, content restrictions, and user-reporting mechanisms designed to detect and restrict prohibited content. These measures may block a request, limit an output, or flag content for review, but no automated system is perfect. We may review, restrict access to, or remove content for safety, legal compliance, or enforcement of these Terms. We may temporarily suspend or terminate an account when we suspect a violation, fraud, security risk, or harm to the Service.
You can delete your account through the account settings in the application. Removing the application from your device does not itself delete the account, cancel a subscription, or erase data stored on our servers. Account deletion may not automatically cancel an active subscription with an app store or payment provider; you must manage the subscription separately through the channel where you purchased it.
10. Third-party services
The Service uses third-party services for sign-in, hosting, artificial intelligence, image generation, payments, and mobile app-store functionality. Their own terms and privacy policies may apply. We do not control independent third-party services or service interruptions.
11. Disclaimer of warranties
To the extent permitted by applicable law, the Service is provided "as is" and "as available." We do not guarantee that the Service will operate without interruption or error, be completely secure, or meet your expectations, or that content will be accurate, unique, lawful, or fit for a particular purpose. Warranties that cannot legally be excluded remain unaffected.
12. Limitation of liability
To the fullest extent permitted by applicable law, Monay Studio is not liable for indirect, incidental, or consequential loss arising from user content, AI-generated output, data loss, third-party services, or temporary unavailability of the Service. This limitation does not apply to intent, gross negligence, personal injury, or liability that cannot be limited under consumer law.
13. Changes to these Terms
We may update these Terms to reflect changes to the product, business model, or applicable law. The new date will be published on this page. We may announce material changes through an in-app notice, the website, or email as required by applicable law. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
14. Governing law and disputes
Subject to mandatory consumer protections and non-waivable rights in your place of residence, these Terms are governed by the laws of the Republic of Türkiye. You retain the right to apply to any consumer arbitration committee, consumer court, or other authority that has jurisdiction under applicable law.
